§ 1 Scope, provider and seller

(1) These terms apply to the purchase and use of the digital product "Kinoa" (the "skin"). Provider and rights holder of the skin is AC Media, owner Adrian Cherlea, Hammersbachweg 199, 74564 Crailsheim, Germany, e-mail: [email protected] ("we").

(2) The seller is Gumroad (Gumroad, Inc.) as reseller ("merchant of record"). The purchase contract is concluded between you and Gumroad under its buyer terms, which are shown to you at checkout. Gumroad is responsible for the conclusion of the contract, prices and VAT, payment, invoice, delivery of the download, and withdrawal and refunds.

(3) These terms additionally govern your right to use the skin, lawful use, bug fixes and our support.

§ 2 Subject – a skin only

(1) The skin is only a user interface (design) for the free media software Kodi. It is provided as a zip file with a manual.

(2) Not included are in particular: the Kodi software itself; add-ons, repositories, "builds" or third-party extensions; movies, TV shows, TV channels, music, streams, accounts, IPTV lists or any other content; support for setting up or running third-party software.

(3) The skin does not provide access to any content. Which content you play with Kodi is solely your responsibility.

§ 3 Purchase via Gumroad

(1) The buy button takes you to the Gumroad checkout, which shows the final price including any applicable VAT, the payment methods and Gumroad's terms.

(2) After payment Gumroad sends you a confirmation e-mail with the download link. Please keep a copy of the downloaded file.

(3) Withdrawal and refunds follow Gumroad's terms and the statutory right of withdrawal. See right of withdrawal.

§ 4 Right of use

You receive the simple, non-transferable right of use described in the license terms. Sharing, reselling, publishing and preinstalling on devices for third parties are prohibited.

§ 5 Lawful use – note on add-ons

(1) You undertake to use Kodi and the skin only in compliance with applicable law.

(2) Using add-ons or sources that provide copyrighted content without the rights holders' permission is illegal and may lead to criminal and civil prosecution. By purchasing, you confirm that you will use Kodi and Kinoa only with legal content – for example your own media collection or legal streaming services.

(3) Legal consequences may in particular be civil claims (injunction, damages, costs of warning letters) and criminal liability under § 106 of the German Copyright Act. According to the European Court of Justice (judgment of 26 April 2017, C‑527/15), streaming from obviously illegal sources is not permitted either.

(4) We do not provide, recommend or link to such add-ons or sources and give no support for them. You alone are responsible for infringements committed using Kodi or the skin.

(5) If you breach paragraph 1, we may stop our voluntary support; further rights remain unaffected.

§ 6 System requirements, bug fixes, support

(1) The skin is made for Kodi 21 "Omega" and can be used on Windows, Android TV devices and Amazon Fire TV. It is not suitable for older Kodi versions. Adaptation to future major Kodi versions is not part of the purchase.

(2) We provide bug fixes for Kodi 21 as a new version via Gumroad; you find them through the link in your purchase confirmation.

(3) We answer questions about the skin by e-mail to [email protected]. Your statutory rights in case of defects against the seller remain unaffected; we support Gumroad in fulfilling them.

§ 7 Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act.

(2) For slightly negligent breach of an essential obligation, liability is limited to the foreseeable damage typical for the contract. Otherwise our liability for slight negligence is excluded.

(3) We are not liable for Kodi, third-party add-ons or content, or for the consequences of unlawful use.

§ 8 Trademarks

Kodi® is a registered trademark of the XBMC Foundation. We are not affiliated with the XBMC Foundation.

§ 9 Final provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the mandatory protection of the law of the country of their habitual residence.

(2) Should any provision be invalid, the validity of the remaining provisions is not affected.
